Chambers has one member who dedicates his practice almost entirely to planning matters and is therefore able to provide a comprehensive service, offering advice & assistance at all levels, representation in Judicial Review proceedings and representation at public enquiries.

Other members of chambers are frequently instructed in planning enforcement matters, both criminal and civil in nature. One member of chambers has significant experience negotiating and drafting s.106 Agreements for a planning authority, involving applications from both large and small-scale developers and providers of affordable housing.

• Planning enforcement.

Chambers has a long history of acting for and against the South’s planning authorities.


Chambers has always dealt with cases arising out of environmental regulation in both the civil and criminal courts and has particular expertise in matters relating to the water and sewage industry. All members of the Planning and Environment Team are comfortable with the technical and scientific issues that often arise in this area of law.

Areas of work previously undertaken include:

• Prosecutions under the Water Resources Act 1991, the Environmental Protection Act 1990 and the Environmental Permitting (England and Wales) Regulations 2010.
• Appeals under Section 80 of the Environmental Protection Act 1990.
• Lands Tribunal claims for compensation.
• Civil claims in nuisance and under the rule in Rylands v Fletcher for environmental damage to land.
• Claims arising out of flooding and land movement.
• Disputes as to riparian rights.

Chambers’ clients include Southern Water, the Environment Agency and many of the South’s local authorities.
