Tom Worthen successfully obtained permission from the Court of Appeal to appeal the judgment of Mr Recorder Storey QC on the grounds that boundary agreements found at trial were void for want of consideration and/or non-compliance with s.2 of the Law of Property (Miscellaneous Provisions) Act 1989. The full appeal, due to be heard in February 2017, will address the law on the limits of when informal boundary agreements can be enforced, building on the current leading authorities of Joyce v Riggoli and Yeates v Line.
