Court of Appeal vary order in Re M (children), [2008] All ER (D) 131 – Rosein Magee acting on behalf of the father.

The judge’s finding that the children had been sexually abused was unjustified, and the residence order granted should be varied as regards the division of the children’s time.  Equality between the mother and the father was what the court should support.
